When access is unrestricted, aid can be delivered in a timely, effective, and non-discriminatory manner that adheres to humanitarian principles, such as neutrality, independence, and impartiality. However, access is often limited or blocked entirely in many humanitarian crises due to ongoing violence, political or military control, damaged infrastructure, bureaucratic obstacles, and natural hazards such as flooding. These barriers delay the delivery of essential aid and can exacerbate the suffering of vulnerable populations, increasing mortality and morbidity rates.
The lack of humanitarian access poses a significant problem for aid organizations, so securing access is a priority to ensure that assistance reaches those who need it most. Under international law, obstructing humanitarian access can amount to a war crime, particularly when done intentionally in violation of the Geneva Conventions. According to the Rome Statute of the International Criminal Court (ICC), deliberately obstructing humanitarian assistance or preventing relief from reaching civilians in conflict zones is classified as a war crime. Blocking humanitarian access may qualify as a crime against humanity when it is part of a widespread or systematic campaign of harm or persecution against a civilian population.
